Context is as follows:

L’article 9 de la [directive] doit être interprété comme suit: un élément dans lequel est incorporé un produit protégé par un brevet qui consiste en une information génétique ou qui contient une information génétique ne peut être considéré comme une ‘matière’ au sens de la disposition précitée lorsqu’il est formellement impossible que l’information génétique liée au produit à caractère génétique exerce sa fonction dans **l’élément incorporant**. À cet égard, le fait que l’information génétique ait effectivement exercé sa fonction antérieurement, lors du processus ayant abouti à la production de **l’élément incorporant**, et pourrait l’exercer à nouveau si elle était isolée de l’élément en question et implantée dans une cellule d’un organisme, n’est pas pertinent en l’espèce.
